This study examines the legal status of the aircraft pilot, analyzing their authorities, obligations, and civil liability as defined under the Libyan Civil Aviation Law No. 6 of 2005 and relevant international conventions. The research adopts a descriptive, analytical, and comparative approach to explore the pilot’s multifaceted role, which transcends mere technical operation to encompass administrative and legal powers in maintaining safety and order on board. It highlights the pilot’s responsibility for the safety of passengers, crew, and the aircraft, while critically evaluating the scope of the pilot’s discretion in emergency situations and the extent of their liability for professional errors. The study identifies gaps in the Libyan legal framework compared to other jurisdictions, particularly regarding access to the flight deck, and provides recommendations to enhance aviation safety standards and align local regulations with international practices.
