Abstract

This research examines electronic means of acquiring knowledge of electronic administrative decisions as a legal consequence of the digital transformation of public administration. It proceeds from the premise that an administrative decision does not become enforceable against individuals merely upon its issuance; rather, its enforceability depends on their knowledge of it through legally recognized means. These means have evolved from traditional forms into electronic forms, namely electronic publication, electronic notification, and electronic actual knowledge. The research aims to assess the adequacy of these means in establishing knowledge of administrative decisions, and their effect on the enforceability of such decisions and the commencement of judicial appeal periods. It also examines the legal requirements governing their validity and evidentiary value. The study adopts a descriptive analytical method, while drawing on the comparative method where appropriate. It concludes that electronic means can perform the same function as traditional means in establishing knowledge of administrative decisions, provided that the necessary legal and technical safeguards are met, particularly clarity of content, official recognition of the medium, and the ability to prove receipt or access. The research further emphasizes the need to develop legislative regulation in a manner that balances administrative efficiency with the protection of individual rights.
